Open Software License (OSL) とはどのようなライセンスか？
(2011/12/19 追記) このライセンスへの疑問点を「Open Software License 3.0 (OSL 3.0) のソフトウェアを使う人への10の質問」としてまとめました。
Open Software License (OSL) というあまり聞いたことのないライセンスがあります。その OSL 3.0 について調べたことのメモです。
なお、OSL のソフトウェアを使う/自分のソフトウェアに OSL を適用する場合は、この記事を鵜呑みにせず、ご自分で確認することをお薦めします。記事の誤りを発見された場合は、お知らせいただけるとありがたいです。
OSL はオープンソースなライセンスである
OSL は OSI に承認されたオープンソースライセンスです。OSI の分類では、「Other/Miscellaneous licenses」に分類されています。
OSL はコピーレフトなライセンスである
Wikipedia では
The OSL is a copyleft license
と説明されています。
OSL には以下の条項があり、オリジナルや派生物を配布したり、それらと通信する場合は OSL でライセンスしなければなりません。
1 c) to distribute or communicate copies of the Original Work and Derivative Works to the public, with the proviso that copies of Original Work or Derivative Works that You distribute or communicate shall be licensed under this Open Software License;
OSL の派生物の定義は GPL とは異なる
Wikipedia では以下のように説明されています。
the definition of Derivative Works in the OSL does not cover linking to OSL software/libraries so software that merely links to OSL software is not subject to the OSL license.
すなわち、OSL は OSL なソフトウェアに対するリンクをカバーしません。OSL なソフトウェアに単にリンクするだけなら、ライセンスを OSL にする必要はありません。
OSL では派生物は以下のように定義されています。
b) to translate, adapt, alter, transform, modify, or arrange the Original Work, thereby creating derivative works ("Derivative Works") based upon the Original Work;
リンクなどの技術的な用語はなく、「to translate, adapt, alter, transform, modify, or arrange the Original Work」とのみ記述されています。
OSL は GPL と非互換である(矛盾する)
FSF は、
The Open Software License is a free software license. It is incompatible with the GNU GPL in several ways.
としています。
GPL と互換性がある(矛盾しない)とは、
あなたは、他のライセンスの下で公開されたコードをGNU GPLの下で公開されたコードと結合して一つの大きなプログラムにすることができます。
という意味ですので、GPL と非互換な OSL のソフトウェアの場合、GPL なソフトウェアと結合して配布することはできないということになります。
OSL は ASP ループホールを閉じたライセンスである
ASP ループホールとは、ASP のように単に自分のサーバ上でコードを実行するだけの場合、配布が伴わないためソースコードの公開義務が生じないことを問題とする用語です。
ASP ループホールを閉じたライセンスとしては AGPL が有名ですが、OSL も ASP ループホールを閉じたライセンスです。
OSL では「External Deployment」(外部展開)という用語を使い、ネットワークを利用して自分以外の誰かが利用できる場合も配布とみなすとしています。
5) External Deployment. The term "External Deployment" means the use, distribution, or communication of the Original Work or Derivative Works in any way such that the Original Work or Derivative Works may be used by anyone other than You, whether those works are distributed or communicated to those persons or made available as an application intended for use over a network. As an express condition for the grants of license hereunder, You must treat any External Deployment by You of the Original Work or a Derivative Work as a distribution under section 1(c).
